1. Acceptance of Terms

By accessing or using the website at cyberneticsplus.com or engaging CyberneticsPlus Services Private Limited ("CyberneticsPlus", "we", "us", or "our") for any of its services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access our website or use our services.

These Terms apply to all visitors, clients, and any other individuals or organisations who access or use our website or services. By proceeding, you represent that you have the authority to bind yourself or your organisation to these Terms.

2. Description of Services

CyberneticsPlus provides professional cybersecurity consulting and managed services to businesses and organisations worldwide. Our core service offerings include, but are not limited to:

  • Cybersecurity Consulting: Strategic advisory services covering security programme design, risk assessments, security architecture review, and policy development.
  • Penetration Testing: Authorised simulated attacks against networks, web applications, APIs, cloud environments, and physical infrastructure to identify exploitable vulnerabilities before malicious actors do.
  • Managed SOC (Security Operations Centre): Continuous 24/7 monitoring, detection, and response to security events across client environments using SIEM, EDR, and threat intelligence platforms.
  • Cloud Security: Assessment and hardening of cloud environments across AWS, Azure, and GCP, including identity and access management reviews, misconfiguration detection, and DevSecOps integration.
  • Compliance Consulting: Guidance and support for achieving and maintaining compliance with frameworks and standards including ISO 27001, SOC 2, PCI DSS, GDPR, and DPDP Act (India).

The specific scope, deliverables, timelines, and fees for each engagement are defined in a separate Statement of Work (SOW) or engagement letter agreed between CyberneticsPlus and the client.

3. Acceptable Use

When using our website or any client portal or tool provided by CyberneticsPlus, you agree to the following acceptable use conditions:

  • You must not use our website or services for any unlawful purpose or in any way that violates applicable local, national, or international laws or regulations.
  • You must not attempt to gain unauthorised access to any part of our systems, infrastructure, or client data, or assist any third party in doing so.
  • You must not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software, tools, or methodologies provided or used by CyberneticsPlus.
  • You must not circumvent, disable, or interfere with security features of our website or any systems operated by CyberneticsPlus.
  • You must not use our services to conduct any offensive cyber operations, attacks, or intrusions against any system, network, or individual without explicit prior written authorisation from both CyberneticsPlus and the system owner.
  • You must not transmit any viruses, malware, or other harmful code via our website, contact forms, or communications channels.

CyberneticsPlus reserves the right to suspend or terminate access for any user or client who violates these acceptable use conditions, without liability.

4. Intellectual Property

All content on this website — including text, graphics, logos, icons, images, reports, methodologies, tools, and software — is the intellectual property of CyberneticsPlus Services Private Limited or its licensors and is protected by applicable Indian and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this website without our prior written consent. Limited reproduction for personal, non-commercial reference purposes is permitted, provided that you include clear attribution to CyberneticsPlus.

Engagement deliverables (such as penetration test reports) produced specifically for a client under a contracted engagement are the property of the client upon full payment of invoiced fees, unless otherwise specified in the SOW.

5. Confidentiality

CyberneticsPlus understands that our clients share sensitive information in the course of engagements. We treat all client information with strict confidentiality. Specific confidentiality obligations are governed at the engagement level through Non-Disclosure Agreements (NDAs) that form part of each engagement contract.

Any vulnerability information, system details, credentials, or data shared with CyberneticsPlus during an engagement will not be disclosed to third parties without the client's prior written consent, except where required by applicable law.

We follow responsible disclosure principles. If, in the course of an engagement, we discover vulnerabilities in third-party products or services outside the agreed scope, we will notify the client and, where appropriate, follow coordinated vulnerability disclosure practices.

6. Payment Terms

Fees for our services are agreed upon in advance and stated in the applicable SOW or engagement letter. Unless otherwise specified:

  • Invoices are issued upon milestone completion or at the conclusion of an engagement.
  • Payment is due within 30 days of the invoice date (Net 30).
  • Late payments may incur interest at the rate permitted under applicable law. CyberneticsPlus reserves the right to suspend services for accounts with outstanding overdue balances.
  • All fees are exclusive of applicable taxes (including GST) unless explicitly stated otherwise.

7. Limitation of Liability

Our services are provided with professional care and in good faith. However, cybersecurity is an inherently risk-based discipline, and no service can guarantee complete protection against all threats. Accordingly:

  • Services are provided on an "as-is" and "as-available" basis to the extent permitted by law. CyberneticsPlus makes no warranties, express or implied, beyond those expressly stated in the engagement SOW.
  • To the maximum extent permitted by applicable law, CyberneticsPlus's total aggregate liability to any client for any claim arising out of or related to these Terms or an engagement shall not exceed the total fees paid by that client to CyberneticsPlus in the three months preceding the claim.
  • CyberneticsPlus shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages.

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.

8. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Karnataka, India, without regard to conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended. The seat of arbitration shall be Bengaluru, Karnataka, India. The language of arbitration shall be English.

Notwithstanding the above, either party may seek urgent interlocutory relief from a court of competent jurisdiction in Bengaluru.

9. Termination

Either party may terminate an engagement by providing written notice as specified in the applicable SOW. Upon termination:

  • All fees for work completed up to the termination date become immediately payable.
  • CyberneticsPlus will securely return or destroy any client data and confidential information in its possession, as directed by the client.
  • Provisions of these Terms that by their nature should survive termination — including confidentiality, intellectual property, limitation of liability, and governing law — shall continue to apply.

CyberneticsPlus reserves the right to terminate or suspend services immediately, without notice, in cases of material breach of these Terms or unlawful activity by the client.
